During last year's outbreak of the COVID-19 pandemic, California's Employment Development Department sent out unemployment payments to people in jail. But prosecutors say the department failed to cross-match the names of inmates with the names on the unemployment claims. They say crime rings in Russia and Nigeria are using stolen identities to file fraudulent claims. In addition, the department did not notify law enforcement about the fraud.
The Department of Justice has a policy that authorizes cross-matching for law enforcement purposes. It says this is possible, but it does not routinely cross-match unemployment claims with prison rolls. The state's task force discovered that 650 inmates were receiving fraudulent EDD checks. This came to light after the department responded to a federal Department of Labor subpoena. In addition, EDD did not pay $2 million a year to a company that specializes in fraud detection, Pondera Systems.
The California District Attorneys Association wrote a letter to Governor Gavin Newsom asking him to address the issue and stop fraudulent payments. Newsom responded with a letter of his own, asking the department to do what is necessary to prevent fraudulent payments.
Governor Newsom announced the formation of a strike team to investigate the issues. The team was tasked with recommending reforms to the department.
