INHERITANCE RULES IN SPAIN

If you live in The country, but are ’non-resident’, one course of action to you is to make a Will to ensure that your own Spanish resources are sent out exactly as you would like in the event of your death.
The spanish language Laws on Inheritance state that, on your own death, the estate will be discussed among your heirs in line with the rules of your country of origins. Most Western countries’ Laws of Inheritance -- with the different of the UK : state that children have an automatic right to a part of your estate on your death, even if they are not specifically mentioned in the Will. In Italy your children may automatically receive a share of your own Spanish assets.

Of course, when they do not wish to claim their lawful share of their own ‘Spanish’ inheritance, they can ‘renounce’ their own right with a Spanish Notary public and the estate will be shared among whoever else you could have designated in your own Will (this can be known in Italy as the ‘Legitime’ - that percentage of inheritance reserved legally for your spouse and youngsters, or, failing these, along with other descendant or ascendant relations).
British home owners should also note that although Spanish language Law states that British Law applies in the big event of your dying, British Law also claims that it is the Regulation in the country in which the asset is situated (eg The country) which establishes your legal heirs.
